Colorado law defines assault as unlawfully causing injury to another person. This vague definition often leads to undue assault charges. Thankfully, several legal defenses exist for assault charges, such as self-defense, accident, lack of intent, and heat of passion. Trust Pav Law to represent you fairly and protect your rights.
What to expect if you are charged with assault in Colorado.
Assault charges vary from serious to less severe depending on the circumstances of the alleged assault. Assault can be charged as a misdemeanor or a felony, and as such, carry different consequences if convicted.
- First-degree assault (18-3-202 C.R.S.): Intentionally causing serious injury with a deadly weapon.
- Second-degree assault (18-3-203 C.R.S.): Intentionally causing serious injury without a deadly weapon.
- Third-degree assault (18-3-204 C.R.S.): Negligently causing injury with a deadly weapon.
Penalties for Assault in Colorado
The penalty for assault in Colorado depends on the degree of the assault charge. As with many crimes in Colorado, assault charges come with mandatory minimums. Having an attorney won’t make those minimums go away, but a good attorney can negotiate on your behalf for a more desirable alternative, such as in-home detention or work-release.
- First-degree assault (18-3-202 C.R.S.): Class-3 felony: 10 – 32 years in Colorado State Prison, and/or $3,000 – $750,000
- Second-degree assault (18-3-203 C.R.S.): Class-4 felony: 2 – 6 years in prison (or 5 – 16 years if a deadly weapon or serious injury was involved), and/or $2,000 – $500,000
- Third-degree assault (18-3-204 C.R.S.): Class-1 misdemeanor: 6 – 24 months in jail, and/or $500 – 5,000
